WITHHOLDING OF REMOVAL

Our firm recently won withholding of removal in immigration court for a wonderful family of people who were afraid to return to their home country. Withholding of removal is an immigration benefit which people seeking asylum can apply for alongside their asylum application.

The reason to apply for withholding of removal, in addition to asylum, is because the requirements for asylum and withholding of removal are different from one another and sometimes an immigration judge who is unwilling to grant asylum is willing to grant withholding of removal. That is what happened in this case. Because this family applied for withholding of removal as well as asylum, they will be able to remain in the United States legally with the ability to keep renewing their work permits. In order to apply for withholding of removal, every person who is in court together needs to file their own asylum application.
